A man charged with two counts of felony theft of property beat an appeal by the state of Texas seeking to allow evidence he argued was obtained in violation of his Fourth Amendment right to privacy.
Jessie Jerome White—who was driving a truck hauling a John Deere tractor and trailer in a rural road—had standing to argue that police officers had no reasonable suspicion that he was actually carrying stolen goods, the Texas Court of Appeals, Fourteenth District said Tuesday in an unpublished opinion.
